NORTH SHADE TOWNSHIP ORDINANCE ADOPTION

PLEASE TAKE NOTICE that the following is a summary of an ordinance enacted by the North Shade Township Board on November 17, 2025, at the regular monthly meeting of the Board. The ordinance will become effective upon the day following publication of this notice. A copy of the ordinance may be inspected at the office of the Township Clerk.

NORTH SHADE TOWNSHIP SUMMARY OF ORDINANCE No. 2025-01ORD

A Revocable Ordinance granting to Wolverine Power Supply Cooperative, Inc. for a period of 30 years following publication of this Ordinance, approval to acquire, construct, operate and maintain facilities for the production, transmission and sale of electric energy to its member-distribution cooperatives and between Wolverine and other parties.

NORTH SHADE TOWNSHIP HEREBY ORDAINS:
1. Revocation. The franchise granted herein is revocable by the Township Board as provided by law.
2. No Damage to Street or Rights of Way. The Franchisee shall not injure any street, highway and alley, or in any manner disturb or interfere with any water, sewer or other utility line.
3. Notification & Approval Prior to Construction. The Franchisee, prior to constructing or installing any electric transmission lines or other apparatus, shall notify in writing, the appropriate county and/or township authorities. Upon completion of any construction project, the franchisee shall, to the extent reasonably practical, restore the site to its precondition condition.
4. Construction Encumbrance. The Franchisee shall not allow any street, highway or alley to remain encumbered by construction for any period longer than is necessary to execute the required work.
5. Insurance and Indemnification. The Franchisee shall furnish the Township proof of insurance and hold the Township harmless from any and all cost incurred by the Township because of the Franchisee’s acts and/or omissions while operating its electric utility business within the Township.
6. Legal Compliance. The Franchisee shall comply with all applicable safety requirements, standards and laws, plus all applicable federal, state, and local laws and regulations.
7. Zoning Compliance. Franchisee shall comply with the requirements of the Township and/or the County Zoning Ordinances with respect to any of its installations and operations.
8. Assignment. The Franchise granted by this Ordinance may be assigned by the Franchisee upon written consent of the Township.
9. Effective Date. This Ordinance takes effect the day following the date of the publication per applicable law.
