NOTICE OF ADOPTION
FULTON TOWNSHIP ZONING ORDINANCE AMENDMENT #42
AN ORDINANCE TO AMEND PREVIOUS SOLAR ENERGY SYSTEMS AND SOLAR FARMS DEFINITIONS AND ZONING REGULATIONS
Please take notice that on November 25, 2024, the Fulton Township Board adopted Ordinance Amendment #42, which defines Solar Energy Systems and Solar Farms and their permitted uses and regulations. Copies of the Solar Energy Systems and Solar Farms Zoning Amendment Ordinance can be obtained at the Fulton Township Office and on the Fulton Township website at: www.fultontwp.com.
This Ordinance provides in summary, additions to our previous Solar Energy Systems and Solar Farms Zoning Ordinance Amendment, to provide for Solar Energy Systems as accessory uses in all Districts, to add Solar Farms as special uses in the AG and I-1 Districts, to provide for special use regulations of Solar Farms to require additional site plan materials for Solar Farms in order to maintain the public health, safety, and welfare for the residents of and visitors to Fulton Township.
The Ordinance Amendment has the following sections and catch lines: Section 1: Amendment of Article 15, Section 1503 – for the addition of 4 solar system and parcel definitions. Section 2: Amendment of Article 3, Section 306 to add section 306(E). Section 3: Amendment of Article 4, Section 408 to add Solar Farms as a special land use to the Agricultural District. Section 4: Amendment of Article 4, Section 411, to add Solar Farms as a special land use to the Industrial District. Section 5: Amendment of Article 7: to add section 732, which adds regulations of Solar Farms; Section 6: Amendment of Article 5 – to add Section 509 Solar Farm Special Use Site Plan Required; Section 7: Amendment of Article 7, Section 731 to delete subsections 731.A.7 and 8 which were definitions now defined in Article 15, Section1503; Section 8: Repeal all ordinances or parts of ordinances in conflict with this Ordinance. Section 9: Severability and Form. Section 10: Effective Date. This ordinance shall be effective 7 days following this publication.
