ZONING ORDINANCE AMENDMENT

ORDINANCE NO. 2022-1
Please take notice that on December 13, 2022, the Township Board of Bethany Township adopted Ordinance No. 2022-1, which amends the Zoning Ordinance to add a new section to enact a temporary moratorium on the approval, location, erection, construction, and/or installation of Large Solar Energy Systems within Bethany Township until June 30, 2023. Copies of the Zoning Ordinance Amendment may be obtained from Tracy Howd, Bethany Township Clerk, at 9958 Blair Rd, Breckenridge, MI 48615.
The Zoning Ordinance Amendment provides, in summary, for a new section to enact a temporary moratorium on the approval, location, erection, construction, and/or installation of Large Solar Energy Systems within Bethany Township until June 30, 2023. The Zoning Ordinance Amendment has the following sections and catch lines: Section 1. Amendment to Zoning Ordinance: Adds a new section to impose a moratorium on Large Solar Energy Systems; Section 2. Severability: Provides for severability of the Ordinance if any part is deemed invalid; Section 3. Effective Date: Effectuates the Ordinance as provided by the Michigan Zoning Enabling Act; and Section 4. Repeal: repeals all conflicting ordinances.

- Fowler looking at different CD options.
- Ordinance 2022-1 was passed with a roll call vote.
- New trash containers will be delivered to home during next month to two months. Any questions, please call MMWA.
- No additional ARPA funds have been received.
- New website is progressing.

On December 14, 2022, Seville Township (the “Township”) adopted Ordinance No. 2022–1214–
2, Domestic Animal and Livestock Ordinance (the “Ordinance”). The following is a summary of
the Ordinance. A true copy of the Ordinance is available at the Township Hall, 8143 W Madison
Rd, PO Box 222. Elwell, MI 48832.
Section 1. Purpose. This section states the Purpose of the Ordinance.
Section 2. Definitions. This section provides definitions related to the Ordinance.
Section 3. Animal Units on Less than one acre. This section provides how many animal
units may be kept on property less than one acre in size.
Section 4. Animal Units on two to less than five acres. This section provides how many
animal units may be kept on property two acres but less than five acres in size.
Section 5. Validity and Severability. This section provides that should any portion of the
Ordinance be deemed invalid, such holding shall not effect the validity of the remaining portions.
Section 6. Repealer. This section provides that all other ordinances inconsistent with the
provisions of this Ordinance are hereby repealed but only to the extent necessary to give this
Ordinance full force and effect.
Section 7. Effective Date. This section provides when the Ordinance shall become effective.

DANGEROUS BUILDING ORDINANCE
On December 14, 2022, Seville Township (the “Township”) adopted Ordinance No. 2022–1214–
3, Dangerous Building Ordinance (the “Ordinance”). The following is a summary of the
Ordinance. A true copy of the Ordinance is available at the Township Hall, 8143 W Madison Rd,
PO Box 222. Elwell, MI 48832.
Section 1. Unlawful Conduct. This section makes it unlawful to keep or maintain a dangerous
building as defined under the Ordinance.
Section 2. Definition. This section defines “dangerous building” and other key terms
contained in the Ordinance.
Section 3. Notice; Contents; Hearing Officer; Filing of Notice with Hearing Officer;
Service. This section provides requirements and procedures for providing notice to owners and
occupiers of dangerous buildings.
Section 4. Hearing Officer. This section provides the requirements and procedure for
appointing a hearing officer to address dangerous buildings.
Section 5. Hearing; Testimony; Decision; Order; Nonappearance or Noncompliance;
Review; Order to Show Cause; Cost. This section provides procedures and standards for
conducting hearings involving a dangerous building including, but not limited to, notice,
testimony, and enforcement.
Section 6. Enforcement Hearing. This section provides standards and procedures for an
enforcement hearing based on the Hearing Officer’s Order under Section 5.
Section 7. Implementation and Enforcement of Remedies. This section provides the
remedies available to the Township to address dangerous buildings in the Township.
Section 8. Penalties. This section contains penalties for violations of the Ordinance.
Section 9. Judicial Review. This section provides a process for judicial review of decisions
of the Township Board with regard to enforcement hearings under Section 6.
Section 10. Validity and Severability. This section provides that should any portion of the
Ordinance be deemed invalid, such holding shall not effect the validity of the remaining portions.
Section 11. Repealer Clause. This section repeals any ordinances or parts of ordinances in
conflict with the Ordinance are repealed to the extent necessary to give this Ordinance full force
and effect.
Section 12. Effective Date. This section provides that the Ordinance shall become effective
thirty (30) days following publication

lots and spaces.
Section 6. Grave Opening Charges. This section provides costs and proceedings for grave
openings.
Section 7. Markers or Memorials. This section provides regulations for markers or
memorials in Township owned cemeteries.
Section 8. Interment Regulations. This section provides regulations for interments in
Township owned cemeteries.
Section 9. Ground Maintenance. This section provides regulations for the maintenance of
Township owned cemetery grounds.
Section 10. Forfeiture of Vacant Cemetery Lots or Burial Spaces. This section provides
regulations when a lot or burial space is considered vacant and forfeited.

Township’s ability to purchase cemetery lots or spaces from the owner.
Section 12. Records. This section provides regulations for the keeping of cemetery records.
Section 13. Cemetery Hours. This section provides opening hours for Township owned
cemeteries.
Section 14. Financial Responsibility for Property Damage. This section provides who is
responsible for property damage within Township owned cemeteries.
Section 15. Penalties. This section provides penalty information for violations of the
Ordinance.
